In the Privacy Policy, “we”, “our” and “us” means “the company”; “you” and “your” means any person who accesses and uses this Application; This Privacy Policy covers this Application’s treatment of personally identifiable information that the company collects when you are on this Application and afterwards, and when you use this Application’s services. This policy also covers the company’s treatment of any personally identifiable information (“PII”) that users share and/or the PII which the company may fetch/collect from various service providers with whom the company has integrated its systems to provide the necessary services to you. This policy does not apply to the practices of companies that the company does not own or control or to people that the company does not employ or manage.

  1. COLLECTING PERSONAL INFORMATION

We may collect the following personal information, including but not limited to the following: 

  1. information about your computer including your IP address, geographical location, browser type and version, device information, login timestamps, feature usage data and operating system;
  2. information about your visits to and use of this application including the referral source, session duration/length of visit, page views, system logs and navigation paths;
  3. information, such as your email address, that you enter when you register/login/signup with our application, to set up subscriptions to our emails and/or newsletters, etc.
  4. User Account Information, including name, email address, or direct user input, for the purposes of account creation, authentication, and communication;
  5. Information contained in communications sent to us, including emails, chat logs, and support requests, along with associated metadata;
  6. information such as your identity proofs, if required and submitted to site for legal or website purpose from time to time.

Information that you enter when you create a profile on our Application (for example, your name, profile pictures, gender, birthday, relationship status, interests and hobbies, employment, educational details, institute details, target exams, etc.), which may be requested on the portal from time to time;
  8. Information that you enter while using the services on our Application (including mock test scores, question-level accuracy, and time taken per assessment);
  9. Information that is generated while using our Application, including when, how often, and under what circumstances you use it;
  10. information relating to anything you purchase, services you use, or transactions you make through our website, which includes your name, address, telephone number, email address, and credit card details;
  11. We do not collect government-issued identity credentials, or financial account passwords. 
  12. information contained in any communications that you send to us by email or through our application or our website, including its communication content, metadata and hashed data;
  13. Our application also provides option of referral and hence shall enable collection of referral email id, phone number etc. However, user entering such PII on behalf of the referral shall completely hold consent of the referral for such act and any liability that may arise on us for using such referral’s PII for marketing or otherwise, shall have to be completely indemnify us by you.
  14. If you provide personal information relating to any third party, you represent and warrant that you have obtained all necessary consents and authorizations required under applicable law for such disclosure and processing. You agree to indemnify and hold the Company harmless against any claims arising from unauthorized disclosure of third-party data by you.

Before you disclose to us the personal information of another person, you must obtain that person’s consent to both the disclosure and the processing of that personal information in accordance with this policy. In case of any discrepancies and/or issues arising due to such “on behalf” submission, the submitter shall be liable and obligated under the then existing PII and other applicable rules and regulations.

  12. Where required under applicable law, promotional communications will be sent only on the basis of your explicit consent, and you may withdraw such consent at any time by using the unsubscribe mechanism provided in the communication or by contacting us.
  13. To notify the User about changes or updates to application’s User account.
  14. To respond to the Users to requests, inquiries, comments or concerns.
  15. To allow the User to participate in interactive features of our service when User chooses to do so.
  16. To generate analytics, insights, scoring models, recommendations, alerts, and other intelligence outputs based on your assessment data and user inputs, including through automated or AI-based processing.
  17. To manage subscriptions, billing status, plan eligibility, invoicing, and compliance requirements.
  18. To monitor system performance, detect unauthorized access, prevent abuse or misuse of the Product, and maintain application’s integrity and security.
  19. To create aggregated, anonymized, or de-identified data sets for internal research, product improvement, benchmarking, and reporting purposes, provided such data does not identify any individual.
  20. To provide customer support, onboarding assistance, troubleshooting, training, and technical communications related to your use of the Product.
  21. To comply with applicable data protection, taxation, regulatory, or statutory obligations in jurisdictions where we operate.
  22. To improve and train internal algorithms and machine learning models, provided that such processing is conducted on anonymized or aggregated data and does not identify any individual customer.

The Company does not sell personal data and does not process personal data for purposes unrelated to the operation and improvement of the Product.

By using the Product, the User acknowledges and agrees that anonymized and aggregated data derived may be used for comparative analytics and product development purposes.

  1. CONSENT TO OVERRIDE DND

By using the Application and its services, you specifically provide consent to the company to send you transaction, service explicit & service implicit communications which are essential to continue the services like sending OTP for log-in, Status of Application etc., irrespective of your Do Not Disturb Registration with TRAI, DoT and/or any other Appropriate Authority. Similarly, you provide your explicit consent for sending across various communications on your registered email as well as phone number through various communication applications like WhatsApp as may be integrated with portal in future. 

  1. SHARING OF PERSONAL DATA

As a policy we do not disclose any personal information to anyone other than those to our employees, officers, professional advisors’, third party contractors, third party service providers as reasonably necessary for the purposes set out in this policy.

We may disclose your personal information to any member of our group of companies (this means our subsidiaries, our ultimate holding company /ies and all its subsidiaries) as reasonably necessary for the purposes set out in this policy.

The Product may integrate with or interoperate with third-party platforms and service providers, other technology, hosting, analytics, billing, or communication providers, in order to enable the functionality of the Product. Where you independently choose to connect or enable any third-party integration, such third party may process your information in accordance with its own privacy policy and terms, and may act as an independent data controller. The Company is not responsible for the privacy practices of third parties that operate independently of the Product.

Such service providers are bound by appropriate confidentiality, data protection, and security obligations and process data solely on a need-to-know basis. These may include:

Notwithstanding the foregoing, the company reserves the right (and you authorize the company) to share or disclose your personal information when the company determines, in its sole discretion, that the disclosure of such information is necessary or appropriate:

For the purposes of the Digital Personal Data Protection Act, 2023, ScoreLens acts as a Data Fiduciary. As a Data Principal, you have the right to access, correct, and erase your personal data collected by us. You also maintain the right to nominate a representative and the right to readily available means of grievance redressal regarding your data.

  • Our Services do not address anyone under the age of 18. 
  • We do not knowingly collect personal identifiable information from children under 18. 
  • In the case we discover that a child under 18 has provided us with personal information, we immediately delete this from our servers.

Response Timeline: The Grievance Officer shall acknowledge the receipt of any user complaint within forty-eight (48) hours to seventy-two (72) hours of receiving the email. The Company shall endeavor to resolve the grievance amicably and comprehensively within a period of one (1) month (30 days) from the date of receipt of the complaint.
